Your Obligations
- You confirm that you are 18 years of age or older old and may legally purchase prescription spectacles from Vita Optical.
- You agree to provide any details reasonably requested by Vita Optical in order to confirm that you may legally purchase prescription spectacles.
- You confirm that the details you provide when making purchases from the Vita Optical web site (including name, address, date of birth and any other requested details) are accurate.
- You confirm that you are not registered blind or partially sighted.
- You confirm that you have had an eye test in the past 24 months and that, when requested, you are correctly inputting the prescription information of that test. If you are in any doubt about the information on your prescription, please choose one of the alternative submission methods provided and either post, email or fax a copy of your prescription to us. Supply of Goods
- We will display all the goods on our site as accurately as possible, taking into account techniques that apply to web site design, graphical and photographic technology and indicate measurements.
- All goods are sold subject to availability.
- Unless specially agreed, we will only supply spectacles with lenses of a spherical power between +8.00 and -8.00 (dioptres) and a cylindrical power between +2.50 and -3.50 (dioptres).
- The customer must supply a prescription supplied by a registered ophthalmic optician completed within the last two years.
- It is the customer's obligation to supply correct prescription information from which the lenses will be produced.
- Unless you state otherwise, we use an appropriate average pupillary distance 'PD' to complete your order. This PD measurement has been provided by qualified dispensing opticians. By agreeing to these terms and conditions, and unless you state otherwise, you will be agreeing to let us use an average PD of 63mm for bifocal and single vision distance lenses, we do recommend that you consult your optician to obtain your PD before ordering, and provide that number to us when ordering.
- As standard we use D28 bifocal lenses. These are 28mm wide "D" shaped segments that are positioned vertically 3mm below the centre of the lens and horizontally are centred on your pupillary distance. If they are to be positioned further up or down (higher or lower) then do state on your order.
Price
- The price for the Goods shall, unless otherwise agreed, be the price displayed on the date of purchase in our price list indicated on the Vita Optical web site. The price for the Goods shall be exclusive of all costs of postage and packing which the Customer shall pay in addition (as stated on the web site).
Payment
- Unless otherwise agreed in writing, the customer must pay for the goods at the time of placing the order. Your order will not be accepted until full payment is received.
- Payments to us must be paid in pounds sterling.
- We accept payment by personal cheque or PayPal.
- All credit and charge card payments are subject to validation and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be liable for any non-delivery or delay.
- Transmission of your debit or credit card number or other data in relation to payment for the goods shall be at your entire risk. We cannot accept any responsibility or liability for failures in transmission of information, deletion, non-delivery or failure to store any communications by you.
Recording of Telephone calls
- From time to time the Company may record telephone calls made to our customer services team for training purposes.
Reglazing
- As with any high street optician, your glasses will be reglazed at your own risk.
- Vita Optical will not be held responsible for loss or damage of any glasses in the post.
- We recommend using recorded delivery when sending your glasses to us.
- Your full postal address and order reference should be enclosed so that we may return your reglazed glasses to you.
- Your glasses will be returned in accordance with our usual delivery policy.
Delivery
- Subject to availability, all goods will be dispatched within 28 days of receiving your order, payment and complete prescription details.
- UK orders will be shipped by 1st Class Royal Mail Recorded Delivery.
- European and Worldwide orders will be shipped using Royal Mail Airsure® Priority Handling.
- It is the obligation of the customer to provide the correct delivery details when placing an order.
- Prices displayed on our web site exclude postage and packing.
Our Responsibilities
- Unless it is impossible for us to do so due to circumstances beyond our reasonable control, we will meet our responsibilities under this contract within a reasonable time. In particular, we will not be held responsible for delays caused by our suppliers.
Returning goods
- If the goods supplied are incorrect or defective in any way, you may return them within 10 working days to us for adjustment, replacement, exchange or refund.
- Due to the bespoke nature of prescription glasses, full and partial refunds will only offered at our discretion following manufacture where the goods are not found to be faulty.
- The costs of postage and packaging are non-refundable.
- If you wish to return the goods please email enquiries@vitaoptical.co.uk to advise us and follow the instructions which we will provide to you in a reasonable time.
- You will usually be required to post the goods back to us using 1st Class Royal Mail Recorded Delivery.
- The risk of loss damage to any goods you return to us will remain with you until the goods have been delivered to our premises and accepted by us at those premises.
The cost of returning items to us for adjustment, replacement, exchange or refund will be your responsibility.
The item will be your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.
Resale of goods
- Goods are sold on the basis that they will not be resold to third parties.
Liability
- All goods purchased from the Vita Optical web site are subject to English Law only.
- Nothing in these terms and conditions is to be taken to exclude or restrict any rights which applicable law grants to you in respect of such goods.
- Individual goods may be the subject of additional warranties or guarantees given by their manufacturers directly to you.
- We do not accept any responsibility and will not be liable for any damage to the goods caused by you.
- We shall not be liable to any person for any damage or loss that may arise from the use of any goods displayed on our site.
- Without prejudice to your statutory rights, all the information and materials contained in this site (including, without limitation, text, graphics and links) are provided on an "as is" basis with no warranty and in particular, we do not represent or warrant that the information accessible via this site is accurate, complete or current or that the use of this site will be uninterrupted or error-free.
- Notwithstanding anything else in these terms and conditions, in relation to any one event or series of events relating to the purchase of any goods from the 'Vita Optical' web site, we will not be liable for: (i) claims relating to the availability of the 'Vita Optical' range, the 'Vita Optical' web site, points of purchase, or the success or level of sales resulting there from; (ii) any indirect, incidental or consequential damages or lost profits.
- The above exclusions of liability shall not apply to any damages arising from personal injury or death where they result from our negligence or the negligence of our servants and agents in the course of their duty.
- Neither the customer or the company shall be liable to the other or be deemed to be breach of contract by reason of any delay in performing or any failure to perform, any of it obligations in relation to the goods, if the failure was beyond that parties control i.e; act of God, explosion, flood, fire or accident. War or threat of war, sabotage, or insurrection. Change in Acts, restrictions, regulations or bye-laws.
General
- Notices served under these terms and conditions shall be in writing and will be deemed given when: (1) personally delivered; or (2) when sent by confirmed fax; or (3) three days after being sent by registered mail to the address set out in our despatch note, or to any other later address in the United Kingdom notified for that purpose.
- Any failure by us to enforce any of these terms and conditions shall not affect our right to enforce the rest of these terms and conditions.
- These terms and conditions are subject to change at any time without prior notice to you.
- These terms and conditions shall be governed by and construed in accordance with English Law.
