Conditions of Use

Your Obligations

1. You confirm that you are aged over 18 years old and are legally able to purchase prescription spectacles from Vita Optical.
2. You confirm that you are not registered partially sighted or blind.
3. You agree to provide any details reasonably requested by Vita Optical to confirm that you are legally able to purchase prescription spectacles.
4. You agree to make purchases on the Vita Optical web site using your correct name, address, date of birth and any other details requested.
5. You confirm that you have had an eye test in the past 24 months and that you are correctly inputting the prescription information when requested. (If you are in any doubt about the information, please do not input it - just leave the prescription area unselected, and post, email or fax a copy of your prescription to us on 0870 486 7430)

Supply of Goods

1. We will display all the goods on our site as accurately as possible, taking into account techniques that apply to web site design, graphical and photographic technology and indicate measurements.
2. All goods are sold subject to availability.
3. Unless specially agreed, we will only supply spectacles with lenses of a spherical power between +6.00 and -8.00 (dioptres) and a cylindrical power between +2.50 and -3.50 (dioptres).
4. The customer must supply a prescription supplied by a registered ophthalmic optician completed within the last two years.
5. It is the customer's obligation to supply correct prescription information from which the lenses will be produced.
6. Unless you state otherwise, we use an appropriate average pupillary distance 'PD' to complete your order. This PD measurement has been provided by qualified dispensing opticians. By agreeing to these terms and conditions, and unless you state otherwise, you will be agreeing to let us use an average PD of 63mm for bifocal and single vision distance lenses, we do recommend that you consult your optician to obtain your PD before ordering, and provide that number to us when ordering.
7. As standard we use D28 bifocal lenses. These are 28mm wide "D" shaped segments that are positioned vertically 3mm below the centre of the lens and horizontally are centred on your pupillary distance. If they are to be positioned further up or down (higher or lower) then do state on your order.

Price

1. The price for the Goods shall, unless otherwise agreed, be the price set out on the date of delivery in the Company price list indicated on the internet web site. The price for the Goods shall be exclusive of all costs of carriage which the Customer shall pay in addition (as stated on the web site).

Payment

1. Unless otherwise agreed in writing, the customer must pay for the goods at the time of placing the order. Payments to us must be paid in pounds sterling.
2. We accept payment by Pay Pal Visa/Mastercard/Switch/Solo/Maestro or any other credit card identified on our site that may be accepted by us from time to time.
3. All credit and charge card payments are subject to validation and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be liable for any non-delivery or delay.
4. Transmission of your debit or credit card number or other data in relation to payment for the goods shall be at your entire risk. We cannot accept any responsibility or liability for failures in transmission of information, deletion, non-delivery or failure to store any communications by you.

Recording of Telephone calls

1. The Company may record calls made to our customer services team from time to time for training purposes.

Re-Glazing

1. Please be sure to send your glasses by recorded delivery. Vita Optical will not be held responsible for any glasses lost in the post.
2. Glasses are re glazed at your own risk just as it is with any high street opticians. You will need to enclose your full postal address so that we can return your re glazed glasses to you by recorded delivery.

Delivery

1. Delivery of all goods will be made within 28 days subject to availability.
2. All goods will be delivered to addresses in the United Kingdom only.
3. It is the obligation of the customer to supply the correct delivery details when placing any order.
4. Prices displayed on our web site exclude delivery.

Our Responsibilities

1. We will meet our responsibilities under this contract within a reasonable time unless it is impossible for us to do this due to circumstances outside of our reasonable control, in particular, we will not be held responsible for delays caused by our suppliers.

Returning goods

1. We want you to be totally satisfied with the goods you buy from our site. If you are not happy with the goods you have purchased, you may return them within 10 working days to us for adjustment, replacement, exchange (once) or refund.
2. Due to the bespoke nature of prescription glasses, refunds are offered at our own discretion following manufacture where goods are not found to be faulty.
3. Delivery and packaging costs are non-refundable.
4. Please email returns@vitaoptical.co.uk to advise us that you wish to return the goods and follow the instructions given. This will usually involve you posting the goods back to us using 1st class recorded mail.
5. The risk of damage to any goods you return to us will remain with you until the goods have been delivered to our premises and accepted by us at those premises.

   If you are returning an item to us for a refund or an exchange then the cost of returning the item to us is your responsibility.

   Please note, the item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

Resale of goods

1. Goods are sold on the basis that they are not resold to the general public.

Liability

1. Goods purchased from our site are subject to English Law only.
2. Nothing in these terms and conditions is to be taken to exclude or restrict any rights which applicable law grants to you in respect of such goods. Individual goods may be the subject of additional warranties or guarantees given by their manufacturers directly to you.
3. We do not accept any responsibility and will not be liable for any damage to the goods caused by you.
4. We shall not be liable to any person for any damage or loss that may arise from the use of any goods displayed on our site.
5. Without prejudice to your statutory rights, all the information and materials contained in this site (including, without limitation, text, graphics and links) are provided on an "as is" basis with no warranty and in particular, we do not represent or warrant that the information accessible via this site is accurate, complete or current or that the use of this site will be uninterrupted or error-free.
6. Notwithstanding anything else in these terms and conditions, in relation to any one event or series of events relating to the purchase of any goods from the 'Vita Optical' web site, we will not be liable for: (i) claims relating to the availability of the 'Vita Optical' range, the 'Vita Optical' web site, points of purchase, or the success or level of sales resulting there from; (ii) any indirect, incidental or consequential damages or lost profits.
7. The above exclusions of liability shall not apply to any damages arising from personal injury or death where they result from our negligence or the negligence of our servants and agents in the course of their duty.
8. Neither the customer or the company shall be liable to the other or be deemed to be breach of contract by reason of any delay in performing or any failure to perform, any of it obligations in relation to the goods, if the failure was beyond that parties control i.e; act of God, explosion, flood, fire or accident. War or threat of war, sabotage, or insurrection. Change in Acts, restrictions, regulations or bye-laws.

General

1. Notices served under these terms and conditions shall be in writing and will be deemed given when: (1) personally delivered; or (2) when sent by confirmed fax; or (3) three days after being sent by registered mail to the address set out in our despatch note, or to any other later address in the United Kingdom notified for that purpose.
2. Any failure by us to enforce any of these terms and conditions shall not affect our right to enforce the rest of these terms and conditions.
3. These terms and conditions are subject to change at any time without prior notice to you.
4. These terms and conditions shall be governed by and construed in accordance with English Law.
